Photo and Video Submission Terms
By uploading or submitting any video, photograph, audio, caption, text, or other content (“Content”) to Organic Pet LLC (“we,” “us,” or “our”), you agree to the following Photo and Video Submission Terms.
1. You Keep Ownership of Your Content
You retain ownership of the Content you submit. By submitting Content to Organic Pet LLC, however, you grant Organic Pet LLC a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid, transferable and sublicensable license to use, reproduce, edit, modify, publish, distribute, display, perform, promote, advertise and otherwise use the Content, in whole or in part, for commercial and non-commercial purposes, in any media or format now known or later developed, including websites, social media, advertising, marketing and promotional materials. Organic Pet LLC may use the Content without additional approval or compensation to you.
This license includes, without limitation, the right to use the Content on Organic Pet LLC’s websites and social media accounts, including Facebook, Instagram, TikTok, YouTube, X, and other digital platforms, as well as in email, advertising, promotional materials, compilations, and other Organic Pet LLC content.
2. Editing and Modification
You authorize Organic Pet LLC to edit your Content for presentation and distribution, including shortening or cropping it; adding captions, headlines, graphics, logos, music, voiceovers, or other elements; combining it with other content; changing its format or aspect ratio; and otherwise adapting it for Organic Pet LLC’s websites, social media channels, advertising, or other uses.
Organic Pet LLC is not required to obtain additional approval from you before making these edits or publishing the resulting content.
3. Your Representations
By submitting Content, you represent and warrant that:
You are at least 18 years old.
You created or own the Content, or you have all rights and permissions necessary to submit it and grant Organic Pet LLC the rights described in these Terms.
Your Content does not infringe another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
You have obtained permission from any identifiable person appearing or speaking in the Content to submit the Content and permit its use as described in these Terms.
If a minor appears in the Content, you are the minor’s parent or legal guardian or have obtained permission from the minor’s parent or legal guardian.
You have permission to use any third-party material contained in the Content, including music, photographs, video clips, artwork, or other copyrighted material.
These representations are particularly important because copyright in UGC ordinarily remains with its creator unless appropriate rights are granted, and UGC terms commonly require submitters to confirm they own the material or possess the necessary rights.
4. Names, Usernames and Likenesses
You grant Organic Pet LLC permission to use your submitted name, social media username, profile name, photograph, likeness, voice, pet’s name, and biographical information submitted with the Content in connection with Organic Pet LLC’s use of your Content.
Organic Pet LLC may, but is not required to, identify or credit you when your Content is used.
5. No Obligation to Remove Published Content
Because Content may be distributed across social media platforms, websites, third-party services, advertising systems, or other media, Organic Pet LLC cannot guarantee that Content can be completely removed after publication.
To the extent permitted by applicable law, the license granted to Organic Pet LLC under these Terms is perpetual and irrevocable.
6. Prohibited Content
You may not submit Content that you do not have the right to use or that is unlawful, defamatory, fraudulent, obscene, threatening, abusive, harmful, or otherwise violates the rights of another person.
Organic Pet LLC reserves the right, but has no obligation, to review, reject, remove, or discontinue use of any submitted Content at any time.
7. Release
To the fullest extent permitted by applicable law, you release Organic Pet LLC and its affiliates, officers, directors, employees, agents, licensees, successors, and assigns from claims arising from the authorized use of your Content under these Terms, including claims relating to copyright, right of publicity, privacy, attribution, editing, or compensation.
8. Indemnification
You agree to indemnify and hold harmless Organic Pet LLC and its affiliates, officers, directors, employees, agents, licensees, successors, and assigns from claims, liabilities, damages, losses, costs, and reasonable attorneys’ fees arising from your breach of these Terms, including a claim that you did not own or have permission to submit the Content.
9. Governing Law
These Photo and Video Submission Terms will be governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute relating to these Terms will be subject to the jurisdiction and venue specified in Organic Pet LLC’s general Terms of Use.
10. Acceptance
By checking the acceptance box and clicking “Submit my entry,” you acknowledge that you have read, understand, and agree to these Photo and Video Submission Terms and Organic Pet LLC’s Terms of Use and Privacy Policy.
